End User License Agreement
This End User License Agreement (“EULA”) is a legal agreement between you and Devlex Infotech (“we”, “us”, or “our”) for the use of the StudioFlow AI application (the “Licensed Application”). By downloading or using the Licensed Application, you agree to be bound by this EULA. If you do not agree, do not use the Licensed Application.
1.Scope of License
We grant you a non-transferable license to use the Licensed Application on any Apple-branded device that you own or control, as permitted by the Apple Media Services Terms and Conditions. You may not distribute or make the Licensed Application available over a network where it could be used by multiple devices at the same time. You may not copy (except as permitted by this license), reverse-engineer, decompile, modify, or create derivative works of the Licensed Application.
2.Maintenance and Support
Devlex Infotech is solely responsible for providing any maintenance and support services for the Licensed Application. Apple has no obligation to furnish any maintenance and support services. For support, contact devlexinfotech@gmail.com.
3.Warranty
Devlex Infotech is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the Licensed Application fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) to you. To the maximum extent permitted by law, Apple will have no other warranty obligation, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the sole responsibility of Devlex Infotech.
4.Product Claims
Devlex Infotech, not Apple, is responsible for addressing any claims by you or any third party relating to the Licensed Application or your use of it, including: (a) product liability claims; (b) any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar legislation.
5.Intellectual Property Rights
In the event of any third-party claim that the Licensed Application or your possession and use of it infringes that third party’s intellectual property rights, Devlex Infotech, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such infringement claim.
6.Legal Compliance
You represent and warrant that: (a) you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country; and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.
7.User Content & Conduct
You are solely responsible for the content you import, create, or edit using the Licensed Application, and for ensuring you have the rights to use it. You agree not to use the Licensed Application for any unlawful purpose or in violation of the terms of any third-party platform (such as Instagram or YouTube) that you connect to it.
8.Subscriptions
The Licensed Application may offer auto-renewable subscriptions. Payment is charged to your Apple ID, and subscriptions renew automatically unless canceled at least 24 hours before the end of the current period. You can manage or cancel subscriptions in your App Store account settings.
9.Third-Party Terms of Agreement
You must comply with applicable third-party terms of agreement when using the Licensed Application (for example, your wireless data service agreement, and the terms of any platform you connect to).
10.Third-Party Beneficiary
You acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of this EULA, and that, upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary of it.
11.Disclaimer & Limitation of Liability
The Licensed Application is provided “as is” without warranties of any kind to the extent permitted by law. To the maximum extent permitted by applicable law, Devlex Infotech shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use of the Licensed Application.
